Insurance Runs on Documentation, Crime Survives on Deniability
Why participants in illegal activities cannot pool their own money for protection. The promise is unenforceable, the arrangement may itself be unauthorised insurance, and — structurally — everything insurance requires to function (written agreement, identified participants, records, a planned triggering event) is the same list a prosecutor needs to prove conspiracy, premeditation and organisation. Risk transfer is a legibility machine, so activities that depend on illegibility cannot use it.
There is a clean structural reason you cannot build insurance for a crime, and it is more interesting than "it's illegal". **Insurance runs on documentation. Crime survives on deniability. The two requirements are mutually destructive.** The point emerges from a natural question: if no insurer will cover an illegal activity, why not have the participants pool their own money — everyone puts in a few thousand, it pays out if someone is hurt, and it is returned if nothing happens? Pooling is lawful. The intuition seems sound. It fails three times over, and the third failure is the interesting one. ## Failure one: the promise is unenforceable A contract to indemnify someone for illegal conduct is void as against public policy. What has been built is a policy no court will honour, which means it provides exactly as much protection as the pot-holder's goodwill and no more. ## Failure two: it may be a separate crime The more it is formalised, scaled, and repeated, the closer it comes to transacting insurance without authority — an offence in every US state, and a felony in many. The documentation is not an incidental byproduct — it is the mechanism by which insurance functions at all. A promise nobody records and nobody can enforce is not insurance; it is a hope. So the trade is: you supply a written confession of agreement, premeditation and organisation, upgrading everyone's exposure from individual offences to an organised conspiracy — and you receive in return a promise no court will enforce. They convert uncertainty into a documented, enforceable, priced obligation, and every step of that conversion requires making the arrangement visible to third parties — insurers, regulators, and courts. Any activity whose viability depends on *not* being legible therefore cannot be insured, and not merely because a statute forbids it. The incompatibility is structural: the thing that would protect you is made of exactly the material that convicts you.
